It is a sad development that citizens of any country, and refugees, may feel they are
powerless
to do something about what is done in their name by their governments.
Worse still that they cannot be bothered.
Archive commentary: The Australian government, of John Howard, has stood resolute about the American's right to incarcerate any of the world's citizens beyond the reach of the US Courts and US Constitution. Be it ina Cuba or flying around the world in CIA planes. This is indeed a strange and difficult thing to comprehend and one wonders what the Australian government of John Howard may hold as "values" other than a some ethereal concept of a failed battle, Gallipoli? For over five years John Howard, and the cabinet members, trashed hundreds of years of legal system. Then suddenly the wind changed and Mr. Howard sensed that a large segment of previously unmoved Australians were questioning what it is that the government stands for in relation to the rights of citizens. The Departments of Attorney General, Immigration and Foreign Affairs had managed to collectivley demonstrate an ineptitude and a culture that looked to be a spreading cancer in the Australian federal bureaucracy. Australian residents had been deported and detained and hundreds of caes came to light. In March 2007 suddenly David Hicks became a political hot potato. Mysteriously the military trial was convened. Then this desperate and dangerous person, according to the constant refrain of senior government Ministers was to be returned to Australia to serve but nine months. The plea bargain excluded the participatio of the US military prosecution and thus is yet another example of the questionable ethics and probity of the US justice system where the Executive places itself above the spirit of the US Constitution and the legal system effectively merging both into the poitical spectrum. Australia and the United States have decided that the fundamental plank of democracy, the separation of powers, shall only apply when they deem it to be in their political interest or of no threat to their power and autocracy.
